The Terms and Conditions for RelTime.com. - Approval of the Terms. Please, read these Terms and Conditions for RelTime.com (hereafter the “Terms”) from RTC AS (hereafter “RTC”) regarding the website RelTime.com thoroughly.
- The RelTime.com or other RelTime web-sites under other top-level domains with corresponding web pages (hereafter the “Web Site”) are accessible on the Internet free of charge for everyone (hereafter the “User”). By the User’s use of the Web Site, the User agrees to be bound by the terms set forth in the Terms relevant for non-registered Users. The User agrees that these Terms may, at the sole discretion of RTC, be amended by RTC at any time by posting the amendment or amended Terms on the Web Site.
- By registering as user of the services offered at the Web Site, the User becomes a member of the RelTime community (hereafter “Member”) and agrees to be bound by all the terms set forth herein, as may be modified by RTC from time to time. The Member agrees that these Terms may be amended by RTC at any time by posting the amendment or amended Terms on the Web Site and/or the Member’s “Your Account”.
- Definitions.
- “Terms” shall mean these Terms and Conditions for RelTime.com and other RelTime Web Sites.
- “RelTime Services” shall mean the available services provided from RTC through the RelTime Web Sites.
- “RelTime Web Sites” shall mean the RelTime.com or other RelTime web sites under other top-level domains with corresponding web pages offering the RelTime Services.
- “RTC” shall mean the company RTC AS registered under the laws of Norway and offering the RelTime Services.
- “Third Party Services” shall mean services provided through the RelTime Web Site by other parties than RTC, Users and/or Members.
- “License” shall mean the personal, worldwide, non-exclusive and non-transferable right each Member is given in these Terms section 6. Grant of License to Members.
- “User” shall mean any person or entity visiting or using any RelTime Web Sites, herein Members.
- “Member” shall mean a User that successfully has completed the registration process for a RelTime Web Site.
- “Content” shall mean any content on any RelTime Web Site, herein User Content.
- “User Content” shall mean any content the User has provided through the RelTime Web Site, including material in any format on the Member’s profile, the Member’s own “Your Account” as well as any messages or correspondence to other Members and/or non-Members.
- “Use of Content” shall include a Users usage of content made available on the RelTime Web Site by others than the User himself/herself as well as the making available of User Content to others.
- “Service Period” is normal business hours (08:00 – 16:00) in Norway from Monday-Friday (working days)
- “Your Account” shall mean the individual user account provided to a Member after a successful registration at a RelTime web Site.
- Notices. The parties accept written notices sent by e-mail. RTC shall send such notices to the e-mail address registered by the Member, and the Member shall send such notices as well as other questions relating to this these Terms to RTC to support@reltime.com.
- Intellectual Property Rights. The RelTime Web Sites and the offered RelTime Services are owned and operated by RTC AS or its subsidiaries or affiliates. All of the content featured or displayed on the RelTime Web Sites, including, but not limited to, text, graphics, photographs images, moving images, sound, illustrations and software, is owned by RTC AS and/or its licensors. The RelTime Web Sites and the offered RelTime Services, including, but not limited to, the general design and the content and all elements on the RelTime Web Sites, are protected by copyright, trademark, trade names, patent, design and/or other laws relating to intellectual property rights. Except as explicitly permitted under these Terms or in writing by RTC or its licensors, no portion or element of a RelTime Web Site or its Content may be copied or retransmitted by any means beyond viewing the RelTime Web Site and the Content. The RelTime Web Site and the offered RelTime Services, its content and all related rights shall remain the exclusive property of RTC or its licensors unless otherwise expressly agreed.
- Membership eligibility. Due to privacy regulations, Members are to be 18 years of age or older. Persons over the age of 13 may become Members if the legal guardian of such persons review the Terms and consent to the registration and prepay for Membership services. For Members younger than the age of 15, the legal guardian must specifically provide his/her consent to RTC in the registration process. All Members that wish to offer commercial services, must be 18 years of age or older.
- Grant of License to Members. The license granted herein (hereafter the “License”) is subject to the restrictions outlined in section 3 and below in these Terms. Provided that the User is registered as a valid Member of the RelTime Web Site, RTC grants to the Member a personal, worldwide, non-exclusive and non-transferable right to use the free services available in the RelTime Web Site as described in these Terms and any special conditions related to the service (some services requires prepayment, see description in the available RelTime Services). If no special condition related to the service in question is presented through the RelTime Web Site, the following License will apply:
- After a successful registration as Member, the Member will get its own user account (“Your Account”), and the Member will have the opportunity to use payable services if such services are prepaid to the Member’s own account as described below in section 9 Payment.
- The Member may publish, modify and reproduce his/her own User Content on his/her own profile; AND
- The Member’s Your Account is only valid for use by the Member (the person or entity registered as a Member); AND
- Since the License granted to the Member is personal, the Member shall not share, sub-Member, re-sell, transfer or otherwise distribute content or definite sections thereof to any other parties through file sharing, publication or other means of serving singular or multiple access to the Content in question; AND
- The Member may retain one (1) copy of the Content for back-up purposes during the term of these Terms, in which case the Member must make sure that the Content is assigned with the proper and corresponding proprietary information.
- Obligations for the Member.
- Use of Content is protected by international copyright laws and treaties. Any Use of Content by the Member must constitute permitted and legal use and comply with applicable national and international laws, treatises and practices. Any violation through such use is prohibited by this these Terms and constitutes a breach on the part of the Member. Copyright infringement may be subject to damages to the proprietors of the content as well as criminal liability. RTC and/or its licensors reserve all rights in and to the Content not expressly granted to the Member. The Member obtains no intellectual property right or ownership rights to the Content other than a limited License as expressly stated herein. The Member accepts to abide by the Terms as well as any special condition(s) related to the Content as presented through the RelTime Web Site, either presented from other users, Members or other Third Party Services,.
- Any illicit, illegal, obscene, offensive or similar Use of Content is prohibited under these Terms. Members are obligated to report violations of these Terms to RTC by notice to report@reltime.com. The Member agrees that any Content available for free download is for personal review purposes only, and such Content may not be shared, sold, rented or otherwise distributed in any form. Furthermore, the Member is not allowed to remove any trademarks, copyright notices or other forms of identification embedded in Content retrieved from the RelTime Web Site, or use automated robots, programs, applications or other means of automatically retrieving Content from the RelTime Web Site.
- The Member agrees to take necessary precautions in order to avoid unauthorized access to the RelTime Web Site. The Member shall keep all user ID's and passwords confidential. The Member agrees to report to RTC of any attempt of unauthorized access by notice to report@reltime.com.
- The Member hereby agrees to abide by and follow any procedures and requirements (hereafter the “Member Guidelines”) at any time set forth in and displayed on the RelTime Web Site and/or the Member’s Your Account. The Member acknowledges that the Member Guidelines may at any time be changed by RTC, including, but not limited to, new procedures to be implemented and/or used by the parties regarding the Member, the Content, the RelTime Services, the RelTime Web Site, the payment and other procedures or requirements.
- Members hereby agrees not to impersonate or misrepresent any person or entity; upload, post, transmit, share or otherwise make available any unsolicited or unauthorized advertising, solicitations, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation; upload, post, transmit, share, store or otherwise make publicly available on the RelTime Web Site any private information of any third party, including, addresses, phone numbers, e-mail addresses, Social Security numbers and/or credit card numbers; solicit personal information from anyone under 18 years or solicit passwords or personally identifying information for commercial or unlawful purposes; upload, post, transmit, share or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; intimidate, discriminate or harass another person or entity.
- Terms and obligations specific to certain RelTime Services.
- RelTime Mobile Services: Member accepts that RTC and its licensors may send communications regarding RTC, the RelTime Services and/or other entities by SMS, MMS, text message or other electronic means to Member’s mobile device and that certain information about your Member’s usage of the Mobile Services may be communicated to RTC. The Member agrees to keep his or her own Your Account information updated to ensure that messages to the Member are not sent to third parties.
- RelTime Market Place: RTC is not responsible or liable for any action or inaction of any party to a transaction, for any failure to perform, to pay any amounts due, or to deliver any merchandise or services as promised, or for any other aspect of the transaction.
- RelTime Connect: In order to make RelTime Connect possible, Member must agree to allow RTC and its licensors to check Member’s cookies generated from use of the RelTime Web Site and RelTime Services when the Member is visiting participating third party websites, and allow RTC and its licensors to receive information concerning the actions taken on those third party websites. In addition, once a Member allows a participating third party website to connect with the RelTime Services, the Member agrees to allow RRTC and its licensors as well as such third party website to generate and publish news feed and other stories about Member’s actions on such web sites without any additional permission. Member can at any time disable this RelTime Connect service through changing the application settings in Your Account.
- RelTime Pages: RelTime Pages are special profiles used solely for commercial, political, or charitable purposes. Members may not set up a RelTime Page on behalf of another individual or entity unless expressly authorized to do so by the individual or entity in question.
- Payment (use of RelTime Services that are not free).
- The Member shall, unless otherwise specifically has been agreed with RTC, prepay the necessary amount in the available currency options to RTC’s account at Paypal before accessing any payable services. If the prepaid amount is used during the Member’s use of the paid service, the Member acknowledges that the paid service may be stopped automatically without any warning. The Member acknowledges that RTC has the right to collect such prepaid amounts that the Member has used by the Member’s usage of the said payable services without forwarding any invoice or other notice to the Member. Each Member may see on his or her Your Account the remaining amount (the amount the Member himself or herself has prepaid to RTC that has not been used by such Member).
- In order to send payments, each Member must have his or her own PayPal Account. Payments will be sent from the Member’s PayPal account to RTC’s PayPal account. Since PayPal and the Member’s bank are examples of Third Party Services, the Member acknowledges that the Member is personal responsible for his or her own payments as well as agreements with such third parties. The Member is responsible for the Member’s compliance with the relevant legal agreements provided from PayPal, see www.paypal.com including the “User Agreement for PayPal Service”, applicable fees and applicable used policies that PayPal request. The Member is responsible for authorizing PayPal to charge the Member’s credit/debit card or to instruct the Member’s financial institution (typically the Member’s own bank) to obtain the funds through the PayPal service.
- In the event of overdue Member fee payments, RTC shall be entitled to claim the current statutory overdue interest rate on any overdue payments from the due date until payment in full is received by RTC, and the Member shall reimburse RTC for all incurred collection costs.
- RTC shall not under any circumstances, with the exception of the provisions set out below under section 9 e, be under any obligation to refund any fees paid by the Member for Member Content. In case RTC, at its sole discretion, determines that the Member is eligible for a refund, and to the extent possible, such amendments shall be made by way of the payment method applied for the case in question, see Refund Policy.
- If a User, pursuant to these Terms, or mandatory provisions of law that, notwithstanding clause 16 of these Terms, have the effect of superseding these Terms, is entitled to refund of payment, damages etc, the User shall, within 30 days from the date of the which the customer receive information on the unsatisfactory service, forward the claim and its factual and legal basis, in writing, to RelTime Customer Service, along with necessary payment information. RTC retains the right to process the claim have within reasonable time. To the extent that the Norwegian Act relating to information requirements and right of withdrawal etc. for distance selling and sales outside ordinary business premises ("Lov nr. 105 2000-12-21 om opplysningsplikt og angrerett m.v. ved fjernsalg og salg utenfor fast utsalgssted: Norw.:“angrerettloven") grants a User a right to cancel an agreement between the User and RelTime, Member hereby agrees such claims are to be limited to the part of the service that has not been performed.
- Privacy.
- In terms of respecting the Member’s right to privacy, RTC has a set of practices with regards to personal information RTC make use of about the users of the RelTime Web Site. In order to conduct transactions and for the Member to gain access to the RelTime Web Site, the Member is required to provide certain personal information. Such information may include, but is not limited to, the Member’s name, address, e-mail address, phone number and credit card information. By providing this information, the Member agrees to allow RTC to apply this information in order to conduct the necessary transactions and other services related to the offered Web Site or RelTime Services. The Member also agrees that this information may be shared with affiliates, partners, worldwide offices, subsidiaries and necessary payment processors.

- Delivery of services and support
- RTC will carry out the RelTime Services professionally in accordance with good IT and consultancy practices. Any question regarding service or support shall be sent to RTC by support@reltime.com.
- RTC offers Members e-mail support regarding the delivered RelTime Services that are subject to payment. Support will be carried out by RTC during the Service Period. RTC shall start working on a support request within 8 – eight – hours after the request was acknowledged by RTC.
- RTC will continuously work to improve the RelTime Services. RTC will, at its option, update and/or upgrade the RelTime Services.
- Confidentiality. Information that a party becomes aware of in connection with the entry into or performance of the terms and which concerns the other party’s operations, employees, products, services or confidential information about a third party shall be dealt with confidentially and not made available to unauthorized third parties without the written consent of the other party.
- Force Majeure
- Neither party shall be liable for its failure to perform hereunder as a result of any events of force majeure beyond the party's reasonable control including, but not limited to, acts of God, fire, flood, wars, sabotage, civil strife or demonstrations, strikes, lockouts or other labour disputes, government actions, governmental laws, rules or regulations. If either party's performance is prevented in whole or part by any such event such party shall be excused any of its obligations hereunder during the period of delay of performance resulting from such event.
- Promptly following the date of commencement of any event of force majeure, the party affected by such event shall promptly advise the other party in writing of such date and the nature of such event of force majeure.
- Term and termination.
- These Terms will become effective the day the User or the uses the RelTime Web Site and will apply until the User ends visiting the RelTime Web Site.
- These Terms will become effective for members from the day the RTC either sets up the Member’s “Your Account” or RTC sends the Member a written confirmation that the Member holds a valid RelTime Membership. In addition, this these Terms govern downloading with any subsequent use of any Content from the RelTime Web Site. These Terms are thereafter in effect until termination. Either party may terminate this Agreement by giving the other party a 30 days written notice. RTC may terminate this Agreement immediately by written notice if the Member violates these Terms or the Privacy Policy. If this agreement between the Member and RTC is terminated, either by the parties or due to violations thereof, the Member’s RelTime Membership is also automatically terminated and RTC may delete or otherwise remove the Member’s “User Account” and User Content and other material related to the Member. In the event of termination of this Agreement, the Member is required to delete any of his/her own Content obtained through his/her use of the RelTime Services or RelTime Web Site and copies thereof retrieved from RTC or its licensors and not use any such Content or information.
- Limitation of warranties, liability, disclaimer.
- RTC provides a link between the Third Party Services and the Members of certain telecommunication services. RTC facilitates the RelTime Web Sites including such Third Party Services, but the Member is responsible for payment and complying with additional terms and conditions applicable for such Third Party Services. RTC does not warrant that such Third Party Services are available globally, for all Users or 24/7/365 or the accuracy of information revealed and supplied through Third Party Services.
- RTC provides the RelTime Services to Users and Members on the conditions as set forth in these Terms. RTC strives to secure a high and professional level in terms of the quality of the RelTime Services delivered through the Web Site, but RTC does not warrant that the quality of the Web Site, including any RelTime Services, Content, information or other material or service purchased or obtained by the Member through the Web Site, will meet the Member’s requirements or that it will be free from errors, uninterrupted, timely, secure, or that the results that may be obtained from the use of the Web Site will be accurate or reliable, that the quality of any RelTime Service, Web Site, Content, information, or other material used, purchased or obtained by the Member through the Web Site will meet the Member’s expectations, and that any errors will be corrected. Risk related to the quality and performance of the RelTime Service is entirely with the Member.
- The RelTime Services is provided “as is” without any condition, warranty or representation of any kind. This includes, but is not limited to, commercial application of content, suitability for particular purposes, variations of editorial use and other mercantile applications. Furthermore, RTC does not warrant the use of names, people, logos, trademarks, patented designs or copyrights or other forms of intellectual property on or in any content displayed on the web site. RTC does not warrant or make representations as to the validity or legality of any release or information thereof associated with any content distributed through the web site. RTC cannot warrant that content provided by Members is conformant to these Terms. If the Member is in doubt, the Member shall seek out competent counsel for the individual case in question. The Member shall indemnify RTC, its subsidiaries and its affiliates against any losses, expenses, costs or damages incurred by any or all of them as a result of the Member’s breach of the Terms of these Terms. The failure of RTC to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such rights or provisions. In no event shall RTC or any of its partners, shareholders, employees, directors or agents be liable for any kind of indirect, consequential, punitive or incidental damages whatsoever in connection with any claim, loss, damage, action or suit arising under or out of these Terms. The Member expressly understands and agrees that RTC shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, even if RTC has been advised of the possibility of such damages, resulting from the use or the inability to use the web site, the cost of procurement of substitute content and services resulting from any content, data, information or services purchased or obtained or messages received or transactions entered into through or from the web site, unauthorized access to or alteration of the Member’s transmissions or data, statements or conduct of any third party on the web site, or any other matter relating to the web site. In any event, RTC’ maximum total aggregate liability to the Member or any other party claiming through the Member, arising in connection with using the web site or subsequent content from the web site, shall not exceed the amount actually received by RTC for the Member’s use of content in question. Some us states and foreign countries do not permit the exclusion or limitation of implied warranties or liability for certain categories of damages. Thus, some or all of the limitations above may not apply to you to the extent they are prohibited or superseded by state or national provisions. RTC is not a seller of copyrights, but facilitates the communication platform used by the Members for usage between Members as well as Members communicating with non-Members through the web site. Thus RTC assumes no liability whatsoever regarding obligations that originate from such copyright issues and relationships between Members and any other party than RTC using the web site from which such issues may arise. Any claims for compensation, damages or payment of any sort made on the basis of the service are subject to the notification procedure set forth in these Terms’ section 9 e. The Member acknowledges that the Member has read these Terms and had the opportunity to seek legal counsel before accepting these Terms. Furthermore, the Member agrees to be bound by the Terms and conditions as set out in these Terms, and that these Terms constitute the contractual and legally binding agreement for the grant of Members through the use of the RelTime Services and the web site.
- Dispute resolution. These Terms and all Member content on the Web Site shall be governed by and construed in accordance with Norwegian law. The User and the Member acknowledges that Oslo city court in Norway shall be the exclusive venue for any legal actions or proceedings arising as a result of these terms.
I hereby give my consent to that RTC Tech AS and its subsidiaries may use my registered information in offering its services to me as member of RelTime, including transfer of personal information to our subcontractors that assist us in delivering such services. I have read and accepted the Privacy Policy. I am aware that as a registered user, my usage of RelTime, as well as the usage of Cookies, generates information that constitutes personal information. You may at one time withdraw this consent and Resign as Member of RelTime, and the personal information about you will be deleted after you have completed the actions regarding your withdrawal. I hereby give my consent to that RTC Tech AS and its subsidiaries can contact me for marketing purposes through the contact information that I have provided, such as my e-mail and mobile telephone through SMS and MMS. I hereby state that I am the legal guardian of the minor becoming a Member of RelTime and that I have read RelTime's Privacy Policy and Terms. I hereby consent to the terms set out therein and the privacy statement provided in conjunction with this user registration. Furthermore, I accept that the personal information I provide can be utilized by RTC Tech AS to contact me for verification of this statement.
